01 Acceptance of Terms
By downloading, installing, or using the Nearplay app, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these Terms, you must not use the Service.
These Terms constitute a legally binding agreement between you and Remembr LTD (Company No. 16355328), registered in England and Wales.
02 About the Service
Nearplay is an iOS application that automatically triggers Apple Music playback when you approach a saved destination — called a Destination Drop. The app integrates with Apple Music, Apple Maps, and optionally your device calendar and contacts.
03 Eligibility
You must be at least 13 years of age to use Nearplay. By using the Service, you confirm that you meet this requirement. If you are under 18, you should have the permission of a parent or guardian.
An active Apple ID and an Apple Music subscription are required to use the core playback features of the app.
04 Apple Music Integration
Nearplay uses Apple's MusicKit framework to access and control Apple Music playback. By using this feature, you also agree to Apple's terms of service. Your use of Apple Music is governed by Apple's Media Services Terms and Conditions.
We do not store your Apple Music library data. All music access and playback occurs via Apple's on-device MusicKit APIs.
05 Spotify — Coming Soon
Spotify integration is not currently available in Nearplay. Users who join the Spotify waitlist are expressing interest in a future feature. Joining the waitlist does not create any obligation on our part to deliver Spotify integration by a specific date, and does not entitle you to any compensation if the feature is delayed or not released.
06 Location, Calendar & Contacts
Nearplay requires location access to function. By granting location permissions, you acknowledge that the app will monitor your device location in the background to detect proximity to your Destination Drops.
Calendar and contacts access are optional features used solely to help you create Destination Drops more quickly. We do not store or share your calendar or contacts data beyond the destination information you choose to save within the app. Calendar access is a Premium feature.
You can revoke any of these permissions at any time in iOS Settings.
07 Your Account
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Please notify us immediately at hello@nearplay.live if you suspect any unauthorised use of your account.
You may not share your account or transfer it to another person.
08 Acceptable Use
You agree not to misuse the Service. Prohibited activities include:
- Attempting to reverse-engineer, decompile, or extract the source code of the app
- Using the Service in any way that violates applicable laws or regulations
- Attempting to gain unauthorised access to our systems or other users' accounts
- Using the Service while driving in a manner that endangers yourself or others
Nearplay is designed to operate automatically in the background. Please use the app responsibly and in compliance with all road safety laws in your jurisdiction.
09 Subscriptions & Payments
Nearplay offers a free tier and paid Premium subscriptions. The following plans are available:
All purchases are processed by Apple through the App Store. Subscription renewal, cancellation, and refunds are governed by Apple's App Store Terms. We reserve the right to change pricing with reasonable notice.
10 Intellectual Property
All content, design, branding, and code that make up Nearplay are owned by Remembr LTD or its licensors. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.
The Nearplay name, logo, and associated marks are trademarks of Remembr LTD.
11 Availability & Changes
We aim to keep Nearplay available at all times but do not guarantee uninterrupted access. We may update, modify, or discontinue features at any time. We are not liable for any loss resulting from downtime or changes to the Service.
12 Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, Remembr LTD shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or £50, whichever is greater.
13 Termination
You may stop using Nearplay and delete your account at any time. We may suspend or terminate your access if you breach these Terms. Upon termination, your right to use the Service ceases immediately.
14 Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15 Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. We will notify you of significant changes via the app or email.
